1. Scope
These Terms and Conditions of Sale (“Terms”) govern all sales of products and services offered by TB Molds FZE, including but not limited to silicone molds, silicone mats, pastry tools, stencils, custom-made products, prototypes, and related culinary accessories.
By placing an order through our website, by quotation, by email, or through any commercial channel, the Customer acknowledges having read, understood, and accepted these Terms without reservation.

TB Molds FZE operates under a General Trading License and manufactures, imports, exports, distributes and sells culinary and pastry-related products worldwide.

3. Products
TB Molds FZE offers professional culinary and pastry products intended for food professionals, hospitality businesses, culinary schools, restaurants, hotels, bakeries, and private customers.
Product photographs, renderings, dimensions, technical drawings, and descriptions are provided for illustrative purposes only.
Minor variations in color, dimensions, finish, texture, or appearance resulting from manufacturing processes shall not constitute defects and shall not give rise to any claim.

4. Pricing
All prices displayed on the website or on quotations are expressed in AED (United Arab Emirates Dirhams) unless otherwise specified.
Prices may be modified at any time without prior notice. However, products will be invoiced at the price confirmed at the time the order is placed.
Shipping charges, VAT (if applicable), customs duties, import taxes, and any other governmental fees are not included unless expressly stated.

5. Orders
An order becomes binding only after acceptance by TB Molds FZE and receipt of payment, unless otherwise agreed in writing.
TB Molds FZE reserves the right to refuse, suspend, or cancel any order in the event of:
• Product unavailability
• Pricing errors
• Suspected fraud
• Regulatory restrictions
• Any legitimate commercial reason

6. Payment Terms
Payment may be made through:
• Credit or debit card
• Bank transfer
• Approved online payment gateways
• Any payment method offered on the website
Unless otherwise agreed in writing, all orders must be paid in full prior to production and shipment.
Business customers may benefit from specific payment terms upon approval.

7. Custom-Made and Personalized Products
Custom-made molds, personalized products, prototypes, bespoke designs, and products manufactured according to customer specifications are strictly non-cancellable and nonrefundable once production has begun.
The Customer is solely responsible for reviewing and approving all dimensions, technical drawings, files, specifications, and designs before production.
Any modification requested after approval may incur additional charges and production delays.

8. Intellectual Property
All molds, designs, concepts, technical drawings, CAD files, 3D models, product names, photographs, visual content, and marketing materials remain the exclusive property of TB Molds FZE unless otherwise agreed in writing.
No reproduction, duplication, resale, reverse engineering, copying, or commercial exploitation is permitted without prior written authorization.

9. Delivery
Delivery times are estimates only and do not constitute a contractual obligation.
TB Molds FZE shall not be liable for delays caused by:
• DHL, UPS, FedEx or other carriers
• Customs inspections
• Government authorities
• Import restrictions
• Supply chain disruptions
• Force Majeure events
Risk of loss or damage transfers to the Customer upon handover of the goods to the carrier.
Customers must inspect shipments upon receipt and notify TB Molds FZE of any visible damage or missing items within five (5) calendar days.

10. Import Duties and Taxes
For international shipments, customs duties, import taxes, clearance fees, VAT, and any local governmental charges are the sole responsibility of the Customer.
TB Molds FZE shall not be responsible for delays, costs, or refusals caused by customs
authorities.

11. Returns and Refunds
-Non-Used Products
Returns may only be accepted after prior written approval from TB Molds FZE.
Returned products must be unused, undamaged, and in their original packaging and condition.
-Used Products
For hygiene, food safety, and quality control reasons, any product that has been:
• Used
• Tested
• Filled
• Baked with
• Frozen with
• Brought into contact with food, ingredients, chocolate, sugar, silicone, pastry preparations, or any other material shall not be eligible for return, exchange, or refund.
-Custom Products
Custom-made and personalized products are strictly non-refundable and non-returnable.
-Manufacturing Defects
Products presenting a proven manufacturing defect may be replaced or refunded at the sole discretion of TB Molds FZE following inspection.

12. Commercial Use Disclaimer
Many products sold by TB Molds FZE are intended for professional and commercial use.
The Customer acknowledges that final results may vary depending on recipes, ingredients, temperatures, equipment, production methods, freezing conditions, baking processes, and individual techniques.
TB Molds FZE does not guarantee any specific commercial, artistic, or production result.

13. Food Contact and Regulatory Compliance
The Customer remains solely responsible for ensuring compliance with all local food safety regulations, certifications, and legal requirements applicable in their country or jurisdiction.
TB Molds FZE shall not be liable for misuse of products or non-compliance with local regulations.

14. Limitation of Liability
TB Molds FZE shall not be liable for any indirect, incidental, special, consequential, punitive, or economic damages arising from the purchase or use of its products.
Under no circumstances shall the liability of TB Molds FZE exceed the purchase price of the product concerned.

15. Force Majeure
TB Molds FZE shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, governmental actions, transportation disruptions, labor disputes, war, civil unrest, shortages of raw materials, or other Force Majeure events.

16. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
The parties shall first attempt to resolve any dispute amicably.
Failing an amicable settlement, any dispute arising from these Terms shall be submitted to the competent courts of the Emirate of Sharjah, United Arab Emirates.
